The term "TutoringPals.com" or "we" or "us" refers to the owner of the website and the term "you" or "customer" refers to the viewer or user of the website.

Changes to Terms of Use
TutoringPals.com reserves the right, from time to time, with or without notice to you, to change these Terms of Use in our sole and absolute discretion. The most current version of these Terms of Use can be reviewed by clicking on the "Terms of Use" located at the bottom of the pages of the TutoringPals.com web site. The most current version of the Terms of Use will supersede all previous versions. Your use of the TutoringPals.com web site or continued use of our service after changes are made means that you agree to be bound by such changes.
HOW OUR SERVICE WORKS
Registration
To use the Services, you will need to register on the site, pay any applicable fees, and obtain an account, and password. You are solely responsible for maintaining the confidentiality of your account(s), and password(s) and for all activities and liabilities associated with or occurring under your account(s), and password(s).You agree to (a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration form, (b) maintain and promptly update your information to keep it true, accurate, current and complete. You agree not to use the site, the Services or the Company Content to recruit, solicit, or contact in any form, Tutors or potential Consumers for employment or contracting for a business not affiliated with us without our advance written permission.
Scheduling
You can have as many sessions in a month as you wish to have for each subject. The schedule of the booked sessions will be mailed to you once you book your session with us. All the sessions are one-on-one and may be planned by you anytime according to your convenience. You can have up to 8 sessions scheduled in advance at a time, the earliest session planned must be at least 48 hours in advance. After booking 8 sessions, the next sessions can be scheduled only after usage of one of the 8 sessions. TutoringPals.com retains the right to change this at any time.
TutoringPals.com has the right to place temporary restrictions on usage during peak hours or with certain tutors to ensure equitable availability of sessions to all customers. The term "session" implies 55 minutes of continuous tutoring.
Instant Tutoring
Tutors will be available Sun-Thurs, 4:00 pm to 9:00 pm and once the customer has purchased a monthly package or higher, we will send information regarding accessing these instant tutoring sessions. In these sessions the tutor will be answering questions from other students as well, so, you will be sharing the tutors with other students.
Money-back guarantee
There is 100% money back guarantee if you cancel within the first one week of your monthly subscription . Also, we will reimburse you for any of the unused sessions as long as you notify us within first two weeks of your monthly subscription. These offers of reimbursement or money-back are only for first time subscribers.
For a one hour session package there is no refund, however you can reschedule the session.
Hours of availability
TutoringPals.com provides service 24 hours in a day. Tutors are available during this period though a customer might not always get a tutoring session when he/she needs due to unavailability of tutors for their subject at the specific time or due to technology problems or during a site maintenance window. For your convenience, we prefer you to book your session at least 48 hours before the planned session.
Academic Quality
TutoringPals.com tries to ensure compliance to national and local curriculum and standards; however this is not a guarantee. TutoringPals.com tutors hold atleast a Masters degree in the subject they teach.
Technology
TutoringPals.com uses proprietary, licensed third-party technologies and free technology products. While all attempts are made to ensure stability and availability of technologies used by TutoringPals.com, the company cannot guarantee uptime. You are solely responsible for all service, telephony and/or other fees and costs associated with your access to use of the Services and for obtaining and maintaining all telephone, computer hardware and other equipment required for such access and use.
Account Access; Identity Protection
You are responsible for updating and maintaining the truth and accuracy of the information you provide to us relating to your account. You are also responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or mobile device. You must not share your password with other people. However, if you decide to share your account with other people, you take full responsibility for their actions. Users of public or shared computers or unprotected mobile devices should log out at the completion of each visit to the TutoringPals.com Web site. If you find that you're a victim of identity theft and it involves a TutoringPals.com account, you should notify customer service. Then, you should report this instance to all your credit card issuers, as well as your local law enforcement agency. TutoringPals.com reserves the right to place any account on hold anytime with or without notification to the subscriber in order to protect itself and its partners from what it believes to be fraudulent activity. TutoringPals.com is not obligated to credit or discount a membership for holds placed on the account by either a representative of TutoringPals.com or by the automated processes of TutoringPals.com.
Intellectual Property
Copyright
All content included on the TutoringPals.com web site and delivered to subscribers as part of the service, including text, graphics, logos, designs, photographs, button icons, images, audio/video clips, digital downloads, data compilations, and software, is the property of TutoringPals.com, or its suppliers. The compilation of all contents on this site is the exclusive property of TutoringPals.com. Content shall not be reproduced or used without written permission from TutoringPals.com, or its suppliers. You agree not to decompile, reverse engineer or disassemble any software or other products or processes accessible through the TutoringPals.com web site, not to insert any code or product or manipulate the content of the TutoringPals.com Web site in any way that affects the user's experience, and not to use any data mining, data gathering or extraction method. TutoringPals.com reserves the right to terminate your membership hereunder if TutoringPals.com, in its sole and absolute discretion, believes that you are in violation of this paragraph, such violations including the copying of content provided to you by us or the copying or other unauthorized use of our proprietary content. The use of the TutoringPals.com service is solely for your personal and non-commercial use. Please see the instructions at the end of these Terms of Use for notifying us of the presence of any allegedly infringing content on the TutoringPals.com Web site.
Membership and Billing
You can find the specific details regarding your subscription with TutoringPals.com at anytime by clicking on the "My Account" link, located on the user menu to the right on TutoringPals.com Web site after you login.
Billing
By using the TutoringPals.com service, you are agreeing that we are permitted to bill you a subscription fee, for your use of the TutoringPals.com service. As used in these Terms of Use, "billing" shall indicate either a charge or debit, as applicable, against your Payment Method, including a checking account, where applicable. The subscription fee will be billed at the beginning of your subscription and. your membership will automatically renew for successive monthly subscriptions, without prior notice to you, unless and until you cancel your membership or we terminate it. You must cancel your membership before it renews each month in order to avoid billing of the next month's subscription fees to your Payment Method. The billing cycle will depend on the type of plan you have selected to subscribe. Click on the "My Account" page to see the commencement date for your next renewal period. We will automatically bill your Payment Method each month on the calendar day corresponding to the commencement of your subscription / session whichever is applicable. In the event your membership / session began on a day not contained in a given month, we will bill your Payment Method on the last day of such month. For example, if you became a paying member on January 31st, your Payment Method would next be billed on February 28th. We may change the fees and charges in effect, or add new fees and charges from time to time, but we will give you advance notice of these changes by e-mail. If your Payment Method reaches its expiration date, your continued use of the service constitutes your authorization for us to continue billing that Payment Method and you remain responsible for any uncollected amounts.
Cancellation
If TutoringPals.com cancel's a session for any unforeseen reason, the customer will be given the option of a make-up session at his convenience.
If the customer misses a session, we will offer one make-up session a month, however we cannot guarantee the time or the teacher, and it will not be carried over to the next month. However, it is in the best interest of the student not to cancel any session. If a customer takes a short-term vacation that is less than a month, then he/she will still have to pay for that month since we cannot schedule our teacher for another student for such a short duration. However, TutoringPals.com services are purchased for a full calendar month, and hence the termination will be in effect only from the first day of the following calendar month. No refunds will be issued for services already purchased for the current month, regardless of whether some hours are utilized or not.
Pricing
TutoringPals.com reserves the right to change prices without advance notice and to offer promotions periodically to certain group of customers and thus not available to all customers. Prices will not rise during the current month of subscription but can change for subsequent months.
Web Site Content
We distribute subject content, and other animations and we reserve the right to display and promote the content or other information on our Web site to you in any manner we choose in our sole and absolute discretion. In addition, the TutoringPals.com web site allows you and other third parties to post comments, give feedback concerning the services offered, our tutors, and subject content distributed by us. Any opinions, advice, statements, services, offers, or other information that constitutes part of the content expressed or made available by third parties on the TutoringPals.com web site are those of the respective authors or producers and not of TutoringPals.com, or its shareholders, directors, officers, or employees. TutoringPals.com is not responsible for the accuracy or legitimacy of the information provided by registered tutors. TutoringPals.com can neither confirm nor deny the validity of the information associated with each registered tutor. Any opinions, advice, statements, services or other information that is provided to you by a tutor is only that of the tutor and not of TutoringPals.com, or its shareholders, directors, officers, or employees. Under no circumstances shall TutoringPals.com or its shareholders, directors, officers, or employees be held liable for any loss or damage caused by your reliance on information obtained from a tutor. It is your responsibility to evaluate any information, opinion, statements, services or advice provided by the tutor. If you have a dispute of any kind with one or more tutors, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
Service Testing
From time to time, we test various aspects of our service, including service levels, plans, promotions and pricing, and we reserve the right to include you in or exclude you from these tests without notice.
Electronic Communications
By using the TutoringPals.com service, you consent to receiving electronic communications from TutoringPals.com. These communications will include notices about your account (e.g., shipping and receiving e-mails and other transactional information) and information concerning or related to our service, such as featured content or other announcements, or offerings. Conduct

Unacceptable Behavior:
The following acts are examples of unacceptable behavior and in the event of such or similar behavior occurring, TutoringPals.com reserves the right to terminate the contract without any reimbursement whatsoever:
The student shall not deliberately introduce or attempt to introduce electronic viruses into the teacher’s computer.
The student shall not attempt to 'hack' the teacher's computer.
The student shall not divulge the teacher’s email address or supply any personal information about the teacher to any third party.
The student shall not forward 'junk mail' or any sexually, verbally or politically offensive or threatening material to the teacher.
The student shall not 'save' their correspondence to and from the teacher with a view to copying, showing or publishing such information in any way to any third parties other than the student's parents (where the student is a minor).

Limitations on Use
You must be 18 years of age or older to subscribe to the TutoringPals.com service. While individuals under the age of 18 may utilize the service, they may do so only with the involvement of a parent or legal guardian. A different tutor may be better able to help you.
